Polk County Water Authority Tampering Policy

 

The PCWA Tampering Policy establishes policies and costs associated with damaging, disturbing, or interfering with:

  • Pipe

  • Water meters

  • Locks

  • Valves

  • Cut-offs

  • Switches

  • Batteries and electronics

  • Curb stops

or other property belonging to PCWA, all acts commonly known as "tampering", which is strictly prohibited. This includes, but is not limited to, the misappropriation of water supplied by the PCWA after service has been stopped. The policies and costs associated with tampering apply to owner occupied property, non-owner occupied property, homes in foreclosure, or others as indicated in the policy linked to below.

Polk County Water, Sewage and Solid Waste Authority (herein referred to as PCWA) Tampering Policy Resolution. Revised March 19, 2012.


The PCWA Tampering Policy establishes policies and costs associated with damaging, disturbing, or interfering with pipe, water meters, locks, valves, cut-offs, switches, batteries and electronics, curb stops, or other property belonging to PCWA, all acts commonly known as "tampering", which is strictly prohibited. This includes, but is not limited to, the misappropriation of water supplied by the PCWA after service has been stopped. The policies and costs associated with tampering apply to owner occupied property, non-owner occupied property, homes in foreclosure, or others as indicated below:


OWNER OCCUPIED PROPERTY

  • Owner occupied property shall be defined as property which is occupied by the fee simple title holder.

  • PCWA shall require a deposit of all owners.

  • Deposit will be applied to damages that resulted from tampering with any balance due being the responsibility of the owner.

  • PCWA may require additional deposit in the event of excessive tampering.

  • Violation of the tampering policy of PCWA meters will result in the owner being held responsible for cost as indicated in this policy under the provisions denoted, "TAMPERING FEES AND COSTS". PCWA may remove meter or lock the meter off if tampering occurs.

  • Violation of tampering with PCWA property from the meter to the water main (which requires the removal and re-installation of service line supply) or any other associated property will be charged material, labor required to repair, plus a fifty percent (50%) penalty for services to repair lines or other properties belonging to PCWA.

  • PCWA will seek legal action against any person who violates the tampering policy.

  • A facsimile or e-mail transmission of the lease agreement and/or signed tampering policy which is transmitted to PCWA shall be acceptable as if these documents were originals.

  • If the meter is pulled by PCWA for service of the meter the PCWA will reinstall said meter upon notification by owner. Installation of the meter will be re-installed at no charge to the owner nor tenant ,and will do so within two (2) business days of notification from owner.

  • If a Tenant moves, vacates or abandons or otherwise leaves the service address vacant during the term of the lease, then the owner shall notify PCWA of the vacancy of the service address and the meter shall be pulled.

  • If owner is not aware of such vacancy PCWA will seek any recourse for past due water usage, tampering fees, etc. from the tenant not the owner.

SUBSEQUENT OWNERS THROUGH FORECLOSURE PROCEEDINGS

  • No subsequent owner nor tenant shall be refused water service due to nonpayment of a prior owner nor tenant.

  • However, all owners and tenants which receive water service from PCWA are required to sign a copy of this tampering policy agreement prior to service being provided by PCWA.

OTHERS:

  • Individuals who are not associated with the service address as an owner or tenant who violate this policy by misappropriation of water or by tampering with PCWA meters and/or equipment, will be subject to prosecution under the local ordinances and/or State Laws of Georgia.

NON-OWNER OCCUPIED PROPERTY

  • Non-owner occupied property shall be defined as property which is titled in one name and occupied by a separate person(s).

  • If owner retains service with PCWA then the owner is responsible for deposit and all charges to the account which may include a tampering fee,

  • If Tenant maintains service in their name then the tenant is responsible for deposit, water usage and any tampering fees during the term of the !ease between owner and tenant.

  • Violation of the tampering policy by a tenant of PCWA meters whose name appears on the deposit contract will result in the tenant being held responsible for cost as indicated in this policy under the provisions denoted, "TAMPERING FEES AND COSTS". PCWA may remove meter or lock the meter off if tampering occurs.

  • Violation of tampering with PCWA property from the meter to the water main (which requires the removal and re-installation of service line supply) or any other associated property will be charged material, labor required to repair, plus a fifty percent (50%) penalty for cost incurred to repair lines or other properties belonging to PCWA.

  • Water service will not be denied to a tenant if previous tenant vacates the premises without paying water charges. However, PCWA may require additional deposits if excessive tampering has occurred on the leased property.

  • Before PCWA provides services to a tenant, PCWA must be provided a copy of a properly executed lease agreement between owner and tenant.

  • Before PCWA provides services to a tenant, owner and tenant must sign a copy of this tampering policy. By signing the tampering policy the owner and tenant agree to the terms and conditions set forth in the policy and will be governed by the same.

  • Upon notification to PCWA by the owner or tenant that the tenant is vacating the property the PCWA shall remove the meter from service address. The removal of the meter is to allow PCWA to service and/or repair the meter. The meter will not be removed if PCWA is notified by the owner that he has subsequent tenants moving in and the owner and/or tenants provide PCWA with a copy of a lease agreement, pay a deposit and execute a copy of the tampering policy. Meters may be pulled or locked immediately if tampering or water theft is evident, or at the convenience of the PCWA. In either case, PCWA will attempt to notify the owner in advance.

Contractor costs shall be assessed at standard rate plus fifty percent (50%).


*PCWA will seek any and all legal action that is provided under the Law.
